Terms and Conditions

Before booking a trip with us, please read carefully and be sure that you fully understand the contents of Terms and Conditions as stated below. Receipt of your payment represents your acknowledgment and acceptance of these terms and conditions. Windhorse Tour will be very happy to clarify any questions you may have.

Reservation
You can contact with us by email / MSN messager / Phone call / Tour Inquiry Form to let us know your tour plans. Upon receiving your booking request, one of our travel consultants will start to assist you in buliding a travel plan according to your special requirements and interests. Discuss and change the proposal until it fits your needs.

It is highly recommended that your tour reservation with Yangtze River Cruise be made 50 days prior to the actual traveling date while others tours can be made 30 days prior to the actual traveling date. You can complete your booking by following steps:

1. Once you decide to book the tour with us, a tour agreement will be sent to you by email to state the detailed itinerary, quotation, service terms and booking terms & condition clearly.

2. Please check through your tour agreement and confirm back to us by signing it and send it back to us by fax (+86-28-86254710) or attach the scanned pages by email.

3. Deposit is required after we get your signed tour agreement. 
The tour reservation deposit (50% of your tour fee) should be paid in advance. A reservation for your tour will not be considered firm until the deposit is received. The final payment (50% of your tour fee) should be paid in our Chengdu office or you can pay it to our Lhasa staff once you arrive in Lhasa. If you book a combined china tour or Yangtze Cruise tickets, the balance is required at least 15 days prior to your tour, which will be specified in the tour agreement. 

After you make the deposit and/or balance transfer, please send us the copy of the transfer receipt by email or fax to us at (+86-28-86254710)

4.  A travel memo will be sent to you 7-10 days before your tour starts, which includes details of packing list, travel tips, E-tickets / Cruise ticket receipt, hotel name, guide name and contact phone number, ect.

5. We suggest you to print out your travel confirmation letter, travel memo as a voucher when you start your trip.

Payment
We accept four ways of payment: 
1. Wire transfer (bank transfer);  
2. Paypal;
3. Credit card; 
4. Western Union transfer.

Important note: Regarding the exchange rate we provide is in Chinese currency-RMB, the equivalent quote in USD is based on current exchange rate between the RMB and the USD.  The quote we provide in USD is subject to slight change due to the fluctuation of the exchange rate, though our quote in RMB will remain the same.

Alteration of Itinerary
Alternations to your itinerary before the booking is processed are happily processed free of charge. We want to provide the best tour possible for you. Alterations after we have received your signed tour agreement will attract a fee of 20USD per request.

CYTS Chengdu - Windhorse Tour reserves the right to modify the itinerary of the tour if air schedule or surface transportation changes, and/or events beyond its control make such alteration necessary. In this event, any of the increase or reduction of the tour cost will be calculated and charged accordingly. If the tour itinerary has to be changed at the request of the client/s, any extra charge or loss incurred due to such change will be borne by client/s.

Cancellation refunds

We would feel sorry if you decide to cancel your trip to China/Tibet, however we understand it is compelled against your will.

If the client cancels the trip, the client must notify us by mail or by fax. We calculate your refund on the day when we receive the written cancellation by Beijing time. All refunds to the client will be processed within 20 days of receipt of your cancellation.

The reservation deposit of USD100.00 per person is non-refundable if the client makes cancellation of the tour but it may be applied for your next trip within 12 months. The reservation deposit will not be calculated into the charge of the cancellation percentage.

The cancellation fee will be a certain percentage of the land tour price as follows:
Up to 15 days before departure--------100USD 
15-7 days before departure-----30% of the tour cost
6-3 days before departure--------50% of the tour cost
2 days or less, or no show----------100% of the tour cost 
After the tour begins, any extra charges caused by clients' changes will be added, as tickets cancellation fee, hotel cancellation penalty,etc. Any unused portion is neither refundable nor exchangeable.

If we have to cancel the tour due to the circumstances beyond our control, such as weather, political upheavals, air or rail transportation company etc., we will endeavor to find an alternative tour for the clients or refund all money paid. A full refund will constitute final settlement for the clients; our Company shall not be held responsible for any expenses that may have incurred as a result of the client's booking.

If a tourist has to leave his tour group because of accident, injury, or serious illness, a refund of 50% of the unused tour fare shall be made to the tourist. 
We are unable to refund any amount for unused services due to your early departure, late arrival, or missed days on tours.

Special Cancellation for the Yangtze River Cruises (4/5 star cruises)  
1. A non-refundable deposit of USD100 per person is charged once the Yangtze River cruise is confirmed with payment. 
2. Full payment with all passenger details must be received 30 working days before departure, or space may be cancelled.
3. Booking with tours departure after 30 days, full payment and passenger details should be received. It is refundable if the cruise company can't confirm the tour. 
4. The following cancellation fees will be applied: 
-- Confirmation to 30 working days before departure: USD100 per person 
-- 30-16 working days before departure: 20% of cruise price 
-- 15-7 working days before departure: 50% of cruise price 
-- 7 working days or less before departure: 100% of cruise price

Additional penalties may apply for air, train, ferry or cruise-ship tickets which have already been issued or for deposits paid to hotels on the basis of the cancellation policies of the related parties.

*All cancellations must be in written form and will only be effective upon receipt by Windhorse Tour in specified time as per tour.

Tour Operator's Responsibility    
Windhorse Tour is one inbound-travel branch office of Chengdu China Youth Travel Service, China. Our license Number is L-SC-GJ00004.
We make and secure all arrangements for transportation, sightseeing and accommodations for the tour concerned. Although we take great care in selecting these suppliers;we have no control over them and, therefore, cannot be responsible for their acts or omissions. We act solely as agents for these independent suppliers. By utilizing the services of suppliers, you agree that neither Windhorse Tour nor any subsidiary or affiliate of Windhorse Tour shall be liable for any injury, damage, loss, accident or delay incurred by you or those traveling with you in connection with any accommodations, transportation or other services resulting directly or indirectly from any acts or default of the suppliers or from any occurrence or condition beyond the control of Windhorse Tour, including defects in vehicles or breakdown in equipment. Nor shall Windhorse Tour be liable for any injury, damage, loss, accident or delay resulting directly or indirectly from delays, cancellations or changes in flights, itineraries, schedules, steamers or other services, strikes, theft, sickness, weather, quarantine or other causes. Suppliers' liability may also be limited by law, tariffs or conditions on tickets and in particular you should read and understand the limitations of liability set forth in the airline ticket or other documentation. All accommodations, services and facilities are subject to the laws and customs of People's Republic of China. Windhorse Tour reserves the right to withdraw any tour in this program and to make such alterations in the itineraries as may be found desirable for the convenience of the parties or the proper operation of the tour, in which case the sole liability of Windhorse Tour shall be a refund of fees paid(to see the Alterations). Windhorse Tour reserves the right to decline to accept or retain any person as a member of the tour should such person's visa application is rejected or such person's actions mental condition, physical infirmity of general behavior impede the operation of the tour or the rights, welfare or enjoyment of other members of the tour.

Health Requirements  
Clients should take into account all international travel risks and familiarize themselves with health requirements applicable to the areas they intend to visit. Clients are solely responsible for checking the safety and security conditions, vaccination, and other health requirements of governments in countries visited or transited. The Department of Health or medical practitioners will be able to assist with current health requirements and recommendations.

Before making a trip to Tibet, we highly recommend all travelers to check if he/she is fit to travel and his/her blood pressure and heart condition is normal. Anyone who suffers heart-attack, pulmonary disease, and hypertension is not suggested to enter Tibet.

Insurance and documents
Please make sure to purchase clients' international standard of travel insurance coverage before your departure from your country. You have to obtain your China Visa before your trip to China.

Luggage Allowance  
In accordance with regulations of the General Administration of Civil Aviation of China, the free baggage allowance within China is 20kg for the economy class, 30kg for the business class, and 40kg for the first class, plus limited carry-on luggage. Excess baggage charges are the sole responsibility of the client. Regulations within China specify that all suitcases must have a locking device attached. Failure to follow this regulation may result in refusal by airport staff to load suitcases onto the aircraft.

Complaint & Claim  
Whenever you feel unsatisfied with any service CYTS Chengdu - Windhorse Tour has provided, please inform your local tour guide or your travel consultant immediately to avoid similar problems happening again either before or during your trip. If you want to complain or claim for compensation, you must inform us by email, regular mail, or facsimile in writing within 15 days upon your finish of your tour. Please attach relevant receipts and substantiating evidence to the letter of claim. CYTS Chengdu - Windhorse Tour will not be liable for any claims made later than 15 days after you finish your tour.
